Classical philosophical Daoism and ecofeminism converge on key points. Ecofeminism’s critique of Western dualistic metaphysics finds support in Daoism’s nondualistic, particularist, cosmological framework, which distinguishes pairs of complementary opposites within a process of dynamic transformation without committing itself to a binary, essentialist position as regards sex and gender. Daoism’s epistemological implications suggest a link to ecofeminism’s alignment with a situational and provisional model of knowledge. As a transformative philosophy, the cluster of concepts that give specificity to the Daoist notion of (...) transformation offers content and direction for the notion of transformation central to many ecofeminist philosophies. These affinities offer possibilities for developing the relevance of both philosophies to bear upon a theoretical understanding of how we can live in a respectful and sustainable relationship with our natural environment. In this paper we challenge the idea that valid consent is the golden standard by which a sexual encounter is deemed ethical. We begin by reviewing the recent public focus on consent as an ethical standard, and then argue for a standard that goes beyond legalistic and contractual foci. This is the standard of mutuality which extends beyond the assurance that all parties engaging in a sexual encounter are informed, autonomous, and otherwise capable of making a valid choice: one must (...) also encounter the other with care and loving attention. We develop this claim using Iris Murdoch’s concept of an attitude of “loving attention,” which differentiates our view from the duty of due diligence to ensure that each person is a willing participant in sex, that the rights of others have not been violated, as emphasized by Dougherty. We also address three objections to using mutuality as a measure of ethical sex, namely that it is patronizing, that it is a maximalist position that puts too great a burden on individuals and inhibits their freedom, and that it is an ideal rather than a requirement. We then look at three examples that test the construct of mutuality: the typical college hook-up, sex work, and anonymous sex through glory holes and similar set-ups. (shrink)

Feminist Epistemology and Philosophy of Science: An Introduction is structured around six questions and the answers to them that have been offered by feminist epistemologists and philosophers of science. By showing how these answers differ from those of traditional philosophical approaches, the book situates feminist work in relation to philosophy more generally. The questions are: Who knows? What do we have knowledge of? How do we know? What don't we know? Why does it matter? and How can we know better? (...) In addressing these questions, the book reviews feminist accounts of objectivity, agnotology, issues in social epistemology--including epistemic injustice--and considers how feminist epistemology and philosophy of science aim at better knowledge production. The audience for the book is upper division undergraduates, but it will be useful as a foundation for graduate students and other philosophers who are seeking a general understanding of feminist work in these areas. Inner speech emerges in early childhood, in parallel with the maturation of the dorsal language stream. To date, the developmental relations between these two processes have not been examined. We review evidence that the dorsal language stream has a role in supporting the psychological phenomenon of inner speech, before considering paediatric studies of the dorsal stream’s anatomical development and evidence for its emerging functional roles. We examine possible causal accounts of the relations between these two developmental processes, and consider their (...) implications for phylogenetic theories about the evolution of inner speech and the accounts of the ontogenetic relations between language and cognition. Insurance claims fraud receives increasing attention in the insurance industry, in academic studies and in public policy spheres. Claims fraud is variously viewed as an economic-contractual problem, a moral-psychological problem, a moral-sociological problem or a criminal problem. This article discusses these theoretical perspectives on insurance claims fraud and reviews the empirical evidence on its nature and prevalence. Most research concludes that opportunistic soft fraud is more prevalent than planned criminal fraud, and that consumer ethics, attitudes and psychology are important aspects (...) of the insurance fraud problem. On the contrary, much of the policy focus on reducing fraud has been directed toward detecting and criminalizing fraud. In light of existing research, care must be taken in applying these approaches to address soft fraud. Greater focus on the social and psychological dimensions of insurance claims fraud may increase the success of soft fraud prevention and decrease the likelihood that the focus on fraud will impair insurance relationships. Improving such prevention efforts requires a better understanding of the various dimensions of fraud, the determinants of fraud behaviors and the relationship between fraud behavior and the institutional setting. The welfare and protection of human subjects is critical to the integrity of clinical investigation and research. Institutional review boards were thus set up to be impartial reviewers of research protocols in clinical research. Their main role is to stand between the investigator and her human subjects in order to ensure that the welfare of human subjects are protected. While there is much literature on the conflicts of interest faced by investigators and researchers in clinical investigations, an area that is (...) less explored is CIs that may affect members of IRBs during the institutional ethics review of clinical investigations. This article examines the notion of CIs in clinical research and attempts to develop a framework for a clearer and more balanced approach to identifying CIs that may influence members of IRBs and impede their independence. It will also apply the proposed framework to demonstrate how IRBs possess, or at least may appear to possess, forms of financial CIs and non-financial CIs. The proper identification and management of these CIs is critical to preserving the integrity of clinical investigations and achieving the primary aim of human subjects protection. (shrink)

This article proposes the lens of moral economy as a useful ethical framework through which to assess HRM practice, with a particular focus on the strategic use of contingent work ('non-standard' employment practices including temporary, agency and outsourced work). While contingent work practices have a variety of impetuses we focus here on their strategic use in the pursuit of economic and flexibility goals. A review of the contingent work literature conveys mixed messages about its outcomes for individuals, and more opaquely, (...) for organisations: on the one hand transferring risks yet on the other, creating opportunities. A moral economy lens views employment as a relationship rooted in a web of social dependencies, and considers that ' thick' relations produce valuable ethical surpluses that represent mutuality and human flourishing. Applying such an approach to the analysis of contingent work enables a fresh interpretation of contradictory individual and collective outcomes observed in the research literature. We suggest that evaluations informed by moral economy offer a more holistic appraisal of HRM practices such as contingent work, where both economic and social opportunities and costs can be more fully seen. In this way we not only highlight the ethical inadequacies of neglecting the human in HRM but also the conceptual pitfalls of analytically separating the economic from the social. (shrink)

Divided into three parts, these twelve essays are some of the papers presented at a May 2001 conference to mark the 350th anniversary of Leviathan's publication. Readers might (...) expect a discussion about Leviathan's endurance and relevance as a fundamental text of political philosophy, but this is not the book's main thrust. Instead, the authors engage in a discussion concerning some of the most provocative and controversial questions about Leviathan. Much of the debate centers on how one should interpret it, forcing readers not only to reconsider crucial parts of Hobbes's philosophy, but also the act of interpretation.Part one examines the place that Leviathan holds among Hobbes's political writings. Karl Schumann argues that one should not think of Leviathan as a radical departure from De Cive and that it did not mark the culmination of Hobbes's development as a political philosopher (14). Schumann's essay is not convincing because he effectively points out the consequential ways that Leviathan is distinct. Ted H. Miller suggests, "Leviathan's uniqueness is rooted in its poetic-philosophical innovations"(103). He points out that David Johnston, Quentin Skinner, and others have stressed the significance of its rhetorical style. Miller, however, proposes that it was the context and the company that Hobbes kept during this time that influenced his writing style. Kinch Hoekstra suggests that Hobbes is an unusual de facto theorist and Luc Foisneau believes that Leviathan is unique because of its theory of justice.Part two is devoted to investigating passions and politics in Leviathan. Richard Tuck believes that Hobbes's political philosophy is utopian because it demands a radical transformation of humans as passionate beings. Tuck says that while the Leviathan provides citizens with security, "they are also going to live a life without pride, their sense of their own individual importance reduced to nothing in the face of their commonwealth" (138). Tuck's essay stands in contrast to Tom Sorrell's analysis of the burdens on the sovereign. He concludes that he must be an individual with little, if any, regard for his own ambitions and passions (196). What one is left with is a Hobbesian version of a philosopher king who has his personal appetites in check always looking out for what benefits his subjects. Is [End Page 210] there any guarantee that the sovereign will be non-egotistical and public-spirited? No, because the sovereign has absolute freedom. Sorrell believes, however, that it is in the sovereign's best interest to be unselfish if she is to maintain her sovereignty (193).Quentin Skinner analyzes the classical theory of laughter, relating it to Hobbes's complicated views about it. Political agency in Leviathan is Yves Zarka's topic. It seems that the citizen is merely a subject, but Zarka cautions that one must carefully read the text and remember that certain rights are inalienable. How far one may take what Zarka interprets as the "the right of resistance" remains a debatable question (182). He believes that one might rethink Leviathan as a more complex piece of political philosophy by practicing "back-to front reading" as opposed to a direct-method reading of the text (182). Zarka thinks that citizens may have a more complex and passionate role than commonly thought (182). This is an alluring suggestion, but it is difficult to accept in light of Hobbes's preoccupation with security and obedience.The role of biblical and political authority is the theme for part three. Edwin Curley argues that Hobbes's treatment of covenants with God was possibly a vehicle for him to arouse skepticism about Christianity among his readers. A. P. Martinich rejects Curley's claim and concludes that not only does his argument fail on grounds of logic, but also it requires far too much "reading between the lines" (223). Background Ethics of care provides a framework for health care professionals to manage ethical dilemmas and moral resilience may mitigate stress associated with the process and outcomes of ethical reasoning. This review addresses the empirical study of ethics of care and moral resilience, published in the health care literature, and identifies potential research gaps. Methods and procedure Arksey O’Malley's framework was adopted to conduct this scoping review. A literature search was conducted across six databases: CINAHL Plus with full text, PubMed, (...) PsycINFO, EMBASE, Scopus and MEDLINE. We collected and synthesised information on the nature of studies including study design, methods and key findings. Results While there is an abundance of literature describing the potential strengths of an ethics of care approach to ethical reasoning and growing interest in the role of moral resilience in protecting against moral distress, both concepts have received little empirical attention. A total of six relevant publications were selected for review. No studies explored the relationship between ethics of care and moral resilience. However, studies focused upon ethics of care approach as a facilitator of patient-practitioner professional relationships and effective ethical decision making in health care practice. Current evidence explores key characteristics consistent with moral resilience in health care professionals. Conclusion This review identified a dearth of research in ethics of care and moral resilience in healthcare practice. Further empirical investigation may provide a deeper understanding of the translation of ethics of care and moral resilience to health care practice to facilitate workplace culture. (shrink)

Strike action in healthcare has been a common global phenomenon. As such action is designed to be disruptive, it creates substantial ethical tension, the most cited of which relates to patient harm, that is, a strike may not only disrupt an employer, but it could also have serious implications for the delivery of care. This article systematically reviewed the literature on strike action in healthcare with the aim of providing an overview of the major justifications for strike action, identifying relative (...) strengths and shortcomings of this literature and providing direction for future discussions, and theoretical and empirical research. Three major themes emerged related to (1) the relationship between healthcare workers, patients and society; (2) the consequences of strike action; and (3) the conduct of strike action. Those who argue against strike action generally cite the harms of such action, particularly as it relates to patients. Many also argue that healthcare workers, because of their skills and position in society, have a special obligation to their patients and society more generally. Those who see this action as not only permissible but also, in some cases, necessary have advanced several points in response, arguing that healthcare workers do not necessarily have any special obligation to their patients or society, and even if so, this obligation is not absolute. Overwhelmingly, when talking about the potential risks of strike action, authors have focused on patient welfare and the impact that a strike could have. Several directions for future work are identified, including greater explorations into how structural and systemic issues impact strike action, the need for greater consideration about the contextual factors that influence the risks and characteristics of strike action and finally the need to tie this literature to existing empirical evidence. Two distinct and perhaps mutually exclusive understandings of utilitarianism have emerged in the ethics literature. Utilitarianism is typically regarded as an approach to determine ethicality by focusing on whether or not actions produce the greater good, but has also been conceptualized as a set of traits to which individuals might be predisposed. This paper is designed to clarify the meaning and implications of such utilitarian traits as “results-oriented,” “innovative,” and “a winner.” Although the Janus-headed model of ethical theory from which (...) these traits emerged had been acknowledged by its developer as possibly misrepresenting typical views of utilitarianism, much research using these traits appears to have been conducted without clear recognition of this. If the conceptual foundation underpinning hypothesis development is disconnected from the measure used to test them, then little support for relevant predictions should emerge. A review of the literature which featured utilitarian traits generally confirmed this. This paper also explored the origins and emergence of these traits and suggested that existing evidence that these measure utilitarian ethical predispositions is not especially persuasive. Understanding what utilitarian traits do not assess is critical in order for knowledge about this potentially useful measure to advance. (shrink)
